1. About These Terms

These Terms of Use ("Terms") govern your access to and use of PlayGams, including playgams.com, HTML5 games published under the PlayGams brand, related game pages, subdomains, features, and services.

By accessing or using PlayGams, you agree to these Terms. If you do not agree, do not use PlayGams.

2. Who Operates PlayGams

PlayGams is operated by:

References to "PlayGams", "we", "our", or "us" mean EXMARKETPLACE FZ Ltd.

3. Eligibility

PlayGams is a general-audience entertainment platform.

You may use PlayGams only if you are legally allowed to use online entertainment services in your jurisdiction, meet the minimum age required by applicable law, and comply with these Terms.

PlayGams is not directed to children under 13, or under any higher digital-consent age required in your jurisdiction.

4. Account Registration and Google Sign-In

Some PlayGams features may require an account. Where account access is available, you may sign in using Google Sign-In.

You are responsible for maintaining access to your Google account, keeping your login credentials secure, and all activity that occurs through your account.

You must not create accounts using false or misleading information, access another person's account, or attempt to bypass authentication or security controls.

5. Access to Games

PlayGams provides browser-based HTML5 games. Games may be available through the PlayGams portal, game pages, subdomains, or embedded game frames.

We may add, remove, modify, rename, test, or discontinue games at any time.

Some games may be experimental, in testing, or part of a proof-of-concept release.

6. Wallets, Rewards, In-Game Balances, and Educational Use

PlayGams is a free entertainment and educational platform. Games published under the PlayGams brand are simulations designed to entertain players and to spark casual interest in business and economics concepts.

6.1 Fictional in-game economies

PlayGams games may include virtual wallets, balances, currencies, tokens (including any token referenced inside a specific game by a fictional name such as, by way of example, "BIZC"), coins, gems, rewards, leases, loans, contracts, businesses, "real estate", auction lots, vesting schedules, "crypto" mechanics, "trading" mechanics, market positions, and any other in-game items or systems.

All such items, currencies, tokens, balances, and economies are entirely fictional and exist only inside the relevant game session. They:

  • have no real-money value and are not legal tender;
  • are not money, electronic money, virtual currency, a security, a financial instrument, a regulated payment instrument, a crypto-asset within the meaning of any law (including without limitation Regulation (EU) 2023/1114 ("MiCA"), the rules of the UK Financial Conduct Authority, the U.S. Securities and Exchange Commission, or the U.S. Commodity Futures Trading Commission), a stablecoin, a utility token, an investment, or a means of payment;
  • cannot be exchanged, withdrawn, redeemed, cashed out, transferred to another user, sold, traded, swapped, gifted, or converted into real money, cryptocurrency, or anything of value, real or virtual, inside or outside PlayGams;
  • may be adjusted, reset, recalibrated, suspended, removed, or invalidated at any time, including to correct technical errors, fraud, abuse, balance changes, or product redesign.

6.2 No earnings, no payouts, no gambling

PlayGams does not offer:

  • any opportunity to earn real money, cryptocurrency, or any other thing of value;
  • any payout, cash-out, withdrawal, redemption, or off-ramp from in-game balances to real money or to anything of value;
  • any investment, financial product, brokerage service, payment service, exchange service, or wallet service;
  • any gambling, betting, lottery, prize draw, or game of chance for real money or anything of value.

Any UI label or text in any PlayGams game that uses words such as (without limitation) earn, buy, sell, trade, invest, withdraw, vest, payout, loan, rent, lease, contract, deal, exchange, "real", crypto, money, currency, wealth, estate, property, betting, or any other business, finance, or trading term, is used purely in a simulated, educational, and entertainment context within the closed game environment. Such terms describe gameplay mechanics — they are not, and must not be interpreted as, descriptions of real-world transactions, real-world products, or real-world opportunities.

6.3 Educational and entertainment purpose; not advice

PlayGams games are intended to entertain players and to spark casual curiosity about business and economics concepts. They are heavily simplified and stylised; they do not model real markets and do not reflect actual market dynamics.

Nothing in PlayGams or in any PlayGams game — including in-game events, news headlines, market predictions, "focus" picks, perks, prestige tiers, prices, recommendations, or any other in-game content — is, or should be treated as, financial, investment, tax, legal, accounting, trading, or professional business advice. You must not make real-world decisions based on anything you see in PlayGams.

6.4 No real-money transactions

PlayGams does not accept payments from users, does not sell virtual goods for real money, and does not request banking, payment-card, wallet, or identity information for the purpose of any in-game transaction. If a future version of PlayGams introduces optional paid features, those features will be clearly labelled and will never grant any redeemable real-world value.

6.5 Anti-manipulation

You must not attempt to manipulate rewards, wallet balances, game sessions, event systems, or in-game economies, or to misrepresent any in-game item as something of real-world value.

7. Acceptable Use

You agree not to use PlayGams for unlawful purposes, interfere with security or operation, reverse engineer protected code, use bots or cheats, manipulate rewards or balances, scrape or attack the service, upload malware, impersonate others, violate third-party rights, or bypass advertising, consent, or access-control systems.

We may restrict or suspend access where we reasonably believe these Terms have been violated.

8. Advertising, Consent, and Third-Party Services

PlayGams may display advertising. Advertising and analytics technologies may be subject to user consent through a consent-management platform.

Third-party services may include advertising vendors, analytics providers, authentication providers, hosting providers, database providers, and content delivery networks.

Third-party services are governed by their own terms and privacy policies.

9. Intellectual Property

PlayGams, including its games, software, graphics, interface, branding, text, audio, animations, game logic, and other content, is owned by or licensed to EXMARKETPLACE FZ Ltd.

You may use PlayGams only for personal, non-commercial entertainment purposes.

You may not copy, reproduce, distribute, modify, sell, sublicense, or commercially exploit any part of PlayGams without prior written permission.

10. User Feedback

If you submit feedback, suggestions, bug reports, ideas, or comments, you grant us the right to use them without restriction or compensation.

11. Availability and Changes to the Service

We aim to keep PlayGams available, but we do not guarantee uninterrupted access.

The service may be unavailable due to maintenance, updates, infrastructure issues, third-party interruptions, security incidents, force majeure events, product changes, or discontinuation.

12. Disclaimers

PlayGams is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we disclaim warranties of uninterrupted availability, error-free operation, fitness for a particular purpose, compatibility with every device or browser, and accuracy or completeness of content.

13. Limitation of Liability

To the maximum extent permitted by law, PlayGams and EXMARKETPLACE FZ Ltd are not liable for indirect, incidental, consequential, special, or punitive damages, loss of data, loss of profits, loss of goodwill, service interruptions, unauthorised access caused by your failure to secure your account, or third-party services.

14. Suspension and Termination

We may suspend, restrict, or terminate your access to PlayGams if you violate these Terms, create security or abuse risks, we are required to do so by law, or continued access may harm PlayGams, users, partners, or infrastructure.

15. Privacy

Your use of PlayGams is also governed by our Privacy Policy.

16. Governing Law

These Terms are governed by the laws of England and Wales, unless mandatory local consumer-protection laws require otherwise.

Where possible, disputes should first be addressed through good-faith communication.

17. Language and Authoritative Version

The English version is the sole authoritative version of these Terms, of every other PlayGams legal document (Privacy Policy, FAQ, DSA Compliance Notice, Beta Notice, Contact), of all interface text on the PlayGams portal, of every game published under the PlayGams brand, and of every label, message, dialog, notification, in-game text, screen, or other component of any such game.

Translations into other languages are provided as a courtesy to assist comprehension. They may contain inaccuracies, omissions, machine-translation artefacts, or unintended connotations that change meaning. In case of any conflict, ambiguity, or discrepancy between the English version and any translation — whether on the portal, in a game, in a UI string, or anywhere else — the English version controls and prevails for every legal, contractual, regulatory, and interpretive purpose.

This rule applies across the entire PlayGams platform — playgams.com, every PlayGams legal page, every published game, every page within or about any game, and every other surface or component of the service — without exception.
