PlayGams DSA Compliance Notice

This page contains disclosures that PlayGams is required to publish under Regulation (EU) 2022/2065 (the Digital Services Act, "DSA"). It is provided solely to satisfy DSA requirements. The figures and information on this page are not equivalent to other product metrics or marketing communications about PlayGams.
PlayGams is operated by EXMARKETPLACE FZ Ltd, Unit P7B-16, Level P7, Park Towers, Dubai International Financial Centre, 212278, Dubai, United Arab Emirates (License No. CL7763, Tax Registration No. 100317172300003).
PlayGams is not a very large online platform within the meaning of Article 33 DSA and has not been designated as such by the European Commission. PlayGams currently qualifies as a small or micro enterprise within the meaning of Article 19 DSA and Recommendation 2003/361/EC.
1. Average number of PlayGams's EU monthly active recipients
In accordance with Article 24(2) DSA, PlayGams publishes the average number of monthly active recipients of the service in the European Union, calculated as an average over the preceding six-month period.

The figure is published at least once every six months and is recalculated where required by EU law or by delegated acts adopted under the DSA.
2. Disputes about user content and accounts
If you consider that any content present on PlayGams is illegal under Union law or the law of an EU Member State, you may submit a notice to PlayGams in accordance with Article 16 DSA.
Notices should be sent to info@exmarketplace.com with the subject line "DSA Notice — Illegal Content" and should contain:
- a sufficiently substantiated explanation of why the content is considered illegal;
- the exact URL or other clear identifier of the content;
- the name and email address of the notifier (anonymous notification is accepted only for notices concerning offences referred to in Articles 3 to 7 of Directive 2011/93/EU);
- a statement confirming the notifier's good-faith belief that the notice is accurate and complete.
PlayGams will confirm receipt of complete notices without undue delay and will process them in a timely, diligent, non-arbitrary and objective manner. Final decisions on content removal, restriction or other measures are subject to human review.
Where PlayGams takes a decision to restrict the visibility of content, suspend payments, suspend or terminate the service in whole or in part, or suspend or terminate an account on the ground that the information is illegal or incompatible with our Terms of Use, a statement of reasons will be provided to the affected recipient in accordance with Article 17 DSA.
3. Opportunities to dispute the decisions
Recipients of the service who are addressees of a moderation decision described above may dispute that decision in any of the following ways:
- Internal complaint — by emailing info@exmarketplace.com with the subject line "DSA Complaint" within six months of the decision. Complaints are handled in a timely, non-discriminatory, diligent and non-arbitrary manner, with human review and without sole reliance on automated means.
- Out-of-court dispute settlement — by selecting any out-of-court dispute settlement body certified by a Digital Services Coordinator in a Member State, in accordance with Article 21 DSA. PlayGams will engage with such bodies in good faith.
- Judicial redress — by initiating proceedings before a competent court at any stage, irrespective of any internal complaint or out-of-court settlement.
Notices submitted by trusted flaggers (Article 22 DSA) are given priority and processed without undue delay.
