1. About This Notice
This Beta Notice (the "Notice") describes the beta development stage of the PlayGams platform and explains how users participate in that stage. It applies to playgams.com, all HTML5 games published under the PlayGams brand, all related game pages, subdomains, and any other PlayGams services made available during the beta period.
This Notice is a supplement to the PlayGams Terms of Use, the PlayGams Privacy Policy, the PlayGams DSA Compliance Notice, and the PlayGams FAQ. In case of any conflict between this Notice and the Terms of Use, this Notice prevails for matters specifically concerning the beta stage. For all other matters, the Terms of Use govern.
By accessing or using PlayGams during its beta stage, you confirm that you have read, understood, and accepted this Notice in addition to the Terms of Use and the Privacy Policy. If you do not agree, please do not use PlayGams.

References to "PlayGams", "we", "our", or "us" mean EXMARKETPLACE FZ Ltd as the operator of playgams.com and related game services.
3. What "Beta" Means at PlayGams
PlayGams is currently in a beta development stage. Beta, in the context of this Notice, means a non-final, evolving release of the PlayGams platform that is provided for testing, validation, observation, and improvement purposes, rather than as a finished commercial offering.
The beta stage includes, but is not limited to:
- ongoing development, design iteration, and re-architecture of the platform;
- a limited and intentionally curated catalogue of games available for play, including titles that are themselves in proof-of-concept, alpha, beta, early-access, or pre-release form;
- continuous changes to game mechanics, balance, art, copy, monetisation surfaces, user interface, navigation, in-game wallets, reward rules, and any other element of the service;
- the active collection of technical, behavioural, and operational data required to evaluate gameplay loops, retention, monetisation, advertising performance, technical stability, and other product hypotheses;
- the testing of integrations with third-party providers (including authentication, hosting, content delivery, analytics, and advertising vendors), including integrations that may be temporarily enabled, disabled, replaced, or re-configured;
- the deployment of features that are switched on or off behind feature flags, A/B tests, holdback groups, or other experimental delivery mechanisms.
The fact that PlayGams is in beta does not mean the platform is abandoned, defective, fraudulent, or operated in bad faith. On the contrary: the beta stage reflects the deliberate, transparent, and lawful process by which we develop the platform, validate it with real users in real conditions, and prepare it for general availability.
4. Current State of the Catalog and the Roadmap
During the beta stage, the PlayGams catalogue may at any given time contain:
- Published / Live games — playable titles that we have considered ready enough to expose to users in their current form;
- Coming Soon games — titles whose pages exist for previewing, marketing testing, or audience discovery but which are not yet playable;
- Planned games — titles for which users can express interest via the "I Want!" voting mechanism, allowing us to learn which directions to prioritise;
- Unpublished / archived games — titles that are no longer available to the public but that we may keep referenced internally for archival, audit, or analytics purposes.
The size, composition, and quality of the catalogue during the beta stage is a function of the stage itself: it is a starting point, not the intended end-state of PlayGams. The catalogue is expected to grow, change, and improve over time as part of the normal beta cycle.
PlayGams reserves the right, at its sole discretion, to add, remove, rename, replace, hide, suspend, depublish, rebalance, or restructure any title at any time, including without prior notice, for reasons of product strategy, legal compliance, third-party policy compliance, content policy enforcement, abuse mitigation, technical operations, or any other lawful purpose.
5. Your Role as a Beta Participant
By using PlayGams during the beta stage, you are not merely a passive consumer of a finished product. You participate, voluntarily and free of charge, in the co-development, observation, and validation of the platform.
In particular, you understand and agree that:
- PlayGams is a work in progress and may contain bugs, performance issues, balance issues, broken features, missing features, half-implemented features, placeholders, internal debug surfaces, experimental visual elements, or other rough edges;
- some features may be available to some users and not to others as part of gradual roll-outs or A/B tests, without that constituting discrimination, defect, or breach of any agreement;
- interface text, copy, screenshots, prices, scores, levels, rewards, payouts, badges, votes, language strings, and other displayed content may change at any time, including retroactively, in order to fix mistakes or improve clarity;
- your gameplay session data, click and tap events, time on page, error reports, performance metrics, and other technical signals are collected and processed in the manner described in the PlayGams Privacy Policy in order to evaluate the platform and inform improvement decisions;
- you may receive prompts to provide feedback, complete short in-product surveys, or otherwise participate in user research, and your participation in any such prompt is voluntary.
Your continued use of PlayGams during the beta stage constitutes your informed acceptance of this co-development role and of all the conditions described in this Notice.
6. Feedback, Bug Reports, and Co-Creation
We welcome and actively encourage feedback during the beta stage. You may submit feedback, suggestions, bug reports, ideas, design proposals, content proposals, or any other comments via any of the channels we make available, including the email contacts in this Notice.
Any feedback you submit to PlayGams:
- is provided voluntarily and free of charge;
- is non-confidential, unless we expressly agree otherwise in writing;
- grants PlayGams a perpetual, irrevocable, worldwide, royalty-free, sub-licensable, transferable licence to use, reproduce, modify, adapt, publish, translate, distribute, and commercially exploit the feedback in any form and through any medium, in connection with PlayGams or any future product or service of EXMARKETPLACE FZ Ltd;
- does not entitle you to attribution, compensation, equity, revenue share, or any other consideration, and does not create any partnership, joint venture, or employment relationship between you and PlayGams.
You represent that you have all necessary rights to submit the feedback and that the feedback does not infringe any third-party rights.
This Section 6 is consistent with Section 10 of the Terms of Use ("User Feedback") and is restated here for emphasis given the central role of feedback during the beta stage.
7. Analytics, Telemetry, and Product Research
A core purpose of the PlayGams beta is to observe how the platform behaves in real conditions and to learn from those observations. To achieve that purpose, PlayGams routinely collects, processes, and analyses:
- gameplay events (level completions, business upgrades, in-game purchases of virtual items, taps, scores, durations, and similar signals), including events that carry sequence numbers, signatures, or other integrity checks for fraud prevention;
- session data (session identifiers, start and end timestamps, game played, language, and balance state) used to evaluate retention, engagement, and progression;
- wallet and reward telemetry (when virtual wallets or balances are present), used to evaluate economy design, payout pacing, and abuse-prevention rules;
- technical and device data (IP address, browser and device information, request identifiers, error logs, performance traces) used to maintain quality of service and to diagnose problems;
- interaction and consent data (cookie choices, advertising consent strings, CMP responses, opt-outs) used to enforce your privacy choices and demonstrate compliance with applicable law.
Personal data is processed in accordance with the PlayGams Privacy Policy and applicable data-protection law (including UK GDPR, EU GDPR, and the CCPA / CPRA where applicable). Where required, processing relies on a lawful basis such as contract, legitimate interests, consent, or legal obligation, as described in the Privacy Policy.
Aggregated, pseudonymised, or anonymised data derived from beta-stage activity may be used without restriction to evaluate the platform, train internal models, calibrate game balance, prepare commercial proposals, demonstrate viability to current or prospective partners, and inform any other lawful business purpose of PlayGams.
8. Wallets, Rewards, and Virtual Items During Beta
PlayGams may include virtual wallets, balances, rewards, badges, votes, progression systems, and other in-game items during the beta stage.
You understand and agree that, unless PlayGams explicitly and clearly states otherwise in writing for a specific feature:
- in-game balances and rewards during the beta stage are provided solely for testing, entertainment, and progression purposes;
- they have no real-money value, are not legal tender, are not a security, are not a financial instrument, are not a regulated payment instrument, and do not constitute consideration for any service rendered to PlayGams;
- they cannot be cashed out, withdrawn, redeemed for cash, transferred to another user, sold, traded, swapped, gifted, or exchanged for any other form of value;
- they may be adjusted, reset, recalibrated, suspended, removed, or invalidated at any time, in whole or in part, for any user or group of users, including in response to fraud, abuse, error correction, balance changes, economic redesign, or any other lawful product reason;
- any communication or label that references "money", "earnings", "withdrawals", "payouts", "rewards", or similar concepts within the platform is to be understood as a description of the gameplay loop, not as a promise of real-money compensation.
The "I Want!" voting mechanism and any similar input-collection feature is provided for discovery and prioritisation purposes only. Votes do not create any binding commitment for PlayGams to build, publish, or maintain any specific title.
For the avoidance of doubt, any user-facing word in any PlayGams game such as (without limitation) earn, buy, sell, trade, invest, withdraw, vest, payout, loan, rent, lease, contract, deal, exchange, "real", crypto, money, currency, wealth, estate, property, betting, or any other business, finance, or trading term, is used purely in a simulated, educational, and entertainment context. Such terms describe gameplay mechanics — they are not descriptions of real-world transactions, real-world products, or real-world opportunities.
PlayGams games are intended to entertain players and to spark casual curiosity about business and economics concepts. They are heavily simplified and stylised; they do not model real markets and do not reflect actual market dynamics. Nothing in any PlayGams game is financial, investment, tax, legal, accounting, trading, or professional business advice. You must not make real-world decisions based on anything you see in PlayGams.
9. Advertising and Monetisation During Beta
The beta stage of PlayGams may include advertising surfaces, monetisation experiments, and integrations with third-party advertising and analytics vendors.
You acknowledge and agree that:
- the presence, density, frequency, format, and behaviour of advertising on PlayGams during the beta stage may change at any time without notice as we test different monetisation approaches;
- the vendor list managed through our IAB Europe Transparency & Consent Framework v2.3 Consent Management Platform ("CMP") is the authoritative inventory of advertising and analytics vendors at any given time, and that list may grow, shrink, or change composition during the beta stage;
- where required by applicable law, advertising vendors are loaded only after you grant consent via the CMP, and you may revisit your consent choices at any time;
- the fact that PlayGams is in beta does not waive your rights under applicable advertising-consent or data-protection law.
PlayGams may, at its sole discretion, also engage in non-advertising monetisation experiments, including but not limited to subscription tests, partner integrations, sponsored content tests, or affiliate placements, and may turn any such experiment on or off at any time without notice.
10. Availability, Bugs, and No Service Level Commitments
During the beta stage, PlayGams is provided strictly on an "as is" and "as available" basis.
Without limiting the disclaimers in Section 12 of the Terms of Use, you specifically acknowledge that during the beta stage PlayGams does not promise:
- continuous availability or uninterrupted access to the platform or to any specific title;
- any minimum response time, recovery time, mean time between failures, or other quantitative service-level metric;
- a defect-free experience, a bug-free experience, or a balanced gameplay experience;
- the persistence of any specific wallet balance, score, level, vote, badge, profile element, or other piece of state;
- the persistence of any specific feature, including features that you may particularly enjoy or rely upon;
- the persistence of any specific game in the catalogue, including games you may have invested time into.
We will make reasonable efforts to keep PlayGams available and to fix material bugs we become aware of, but we are not obliged to do so according to any specific timeline.
11. Changes to the Service During Beta
We may, at any time and at our sole discretion, modify, restructure, redesign, rebrand, fork, split, merge, archive, hide, restrict, suspend, or discontinue PlayGams or any part of it during the beta stage.
Without limiting the foregoing, we may, at any time:
- change the catalogue composition (add, remove, replace, rename, rebrand, or reclassify games);
- change the wallet design, economy, and reward rules, including retroactively;
- change the advertising and monetisation surfaces;
- change the interface design, navigation, language strings, and visual identity;
- change the third-party providers we use for hosting, content delivery, authentication, analytics, advertising, payment, support, or any other operational function;
- change the eligibility criteria for any feature, including criteria for the beta programme itself;
- introduce, modify, or remove feature flags, A/B tests, holdbacks, and experimental treatments;
- change the legal and contractual framework that governs PlayGams, including this Notice, by publishing an updated version with a new "Last updated" date.
Material changes will be notified to users in a manner we consider proportionate to the change, including through the website, in-product messages, the consent interface, or email.
12. Disclaimers Strengthened During Beta
To the maximum extent permitted by applicable law, and in addition to and not in derogation of the disclaimers contained in Section 12 of the Terms of Use:
- PlayGams disclaims all warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, timeliness, reliability, security, freedom from viruses or other harmful components, compatibility with any specific device or browser, persistence of user-generated state, persistence of any specific catalogue title, persistence of any specific feature, persistence of any specific advertising or monetisation configuration, persistence of any specific reward rule, and any other warranty whether express, implied, statutory, or arising from a course of dealing or usage of trade;
- PlayGams disclaims any representation that the catalogue currently exposed during the beta stage is representative of the catalogue that will be available at general availability or at any later stage of the platform's life;
- PlayGams disclaims any representation that the platform, during the beta stage, will satisfy the eligibility requirements of any specific third-party advertising network, payment processor, app store, distribution partner, or other commercial intermediary at any specific time;
- PlayGams disclaims any representation, suggestion, or inducement that gameplay during the beta stage will produce or has produced any real-money outcome, financial benefit, or economic gain for the user.
These disclaimers reflect the nature of an evolving beta platform and form an essential part of the bargain on the basis of which PlayGams is made available to you free of charge during the beta stage.
13. Limitation of Liability During Beta
To the maximum extent permitted by applicable law, and in addition to and not in derogation of Section 13 of the Terms of Use, neither PlayGams nor EXMARKETPLACE FZ Ltd nor any of its officers, employees, contractors, advisors, or affiliates shall be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, loss of profits, loss of revenue, loss of business opportunity, loss of goodwill, loss of data, loss of time, frustration, disappointment, or any other damage arising out of or in connection with:
- the availability, unavailability, or performance of PlayGams during the beta stage;
- the presence, absence, modification, removal, or reset of any game, feature, wallet balance, score, reward, badge, vote, profile element, or other piece of state;
- the inclusion or exclusion of any specific advertising vendor, analytics vendor, payment vendor, or other third-party provider;
- the outcome of any experiment, A/B test, holdback, or other test in which you may have been a participant during the beta stage;
- any decision by a third party (including, without limitation, advertising networks, app stores, payment processors, search engines, regulators, or platform partners) to accept, reject, throttle, suspend, or otherwise condition the participation of PlayGams in their programmes, including for reasons related to the beta status of the platform.
Where applicable law prohibits the exclusion or limitation of certain damages, the foregoing exclusions or limitations apply only to the extent permitted by that law.
14. Transition from Beta to General Availability
PlayGams will transition out of the beta stage when EXMARKETPLACE FZ Ltd, in its sole judgement, considers the platform ready for general availability. There is no committed timeline for that transition. The transition may be partial (for example, exiting beta for certain titles or features while keeping others in beta) and may be subsequently revisited.
At and after the transition out of the beta stage:
- the user-facing references to "beta" may be removed or updated;
- this Notice may be retired, renamed, or merged into other PlayGams documents (such as the Terms of Use);
- the relationship between PlayGams and its users will continue to be governed by the then-current Terms of Use, Privacy Policy, DSA Compliance Notice, and any other applicable document.
Nothing in this Section 14 grants users any entitlement to early access, exclusive content, lifetime status, grandfathered terms, or any other benefit on the basis of having participated in the beta stage, except where PlayGams expressly grants such a benefit in writing.
15. Acknowledgement and Acceptance
By accessing or continuing to use PlayGams during the beta stage, you confirm that you:
- understand that PlayGams is an evolving beta platform with all of the characteristics described in this Notice;
- accept that the catalogue, features, wallet design, advertising configuration, and any other aspect of PlayGams may change at any time;
- accept the role of beta participant described in Section 5 of this Notice, including the collection and use of analytics, telemetry, and feedback;
- understand that in-game balances and rewards during the beta stage have no real-money value and are subject to reset or removal;
- accept the disclaimers and limitations of liability in Sections 12 and 13 of this Notice, in addition to the equivalent provisions of the Terms of Use;
- understand that this Notice supplements the Terms of Use, the Privacy Policy, and the DSA Compliance Notice, and that those documents continue to apply.
If you do not accept any of the above, you must stop using PlayGams. Continued use after publication of any updated version of this Notice constitutes acceptance of that updated version.
16. Relationship to Other PlayGams Documents
This Notice operates in addition to, and not in replacement of, the other PlayGams legal documents currently in force, namely:
- PlayGams Terms of Use — governs general access and use of the platform;
- PlayGams Privacy Policy — governs the collection, use, and protection of personal data, including data collected during the beta stage;
- PlayGams DSA Compliance Notice — implements Regulation (EU) 2022/2065 disclosures;
- PlayGams FAQ — provides plain-language answers to common questions;
- any other document published by PlayGams from time to time on playgams.com.
In case of a conflict between this Notice and any other PlayGams document with respect to a matter specifically about the beta stage, this Notice prevails. For all other matters, the more specific document prevails, with the Terms of Use as the default.
